In most areas, adding a backflow preventer is involved with the local water supply. If this is about a well system, then that isn't involved.
Operationally, the backflow overcomes at least 40 psig, so vertical wouldn't be a pressure difference problem; but I'd call Honeywell to find out, as the drawings for the device show it only in the horizontal position.
"Vertical installation of backflow preventers will be accepted if the device is approved by the State for that type of configuration. ..."
