Just a note about this subject, fresh off the wire yesterday.

EPA—1, Coal Burners—0
The U.S. Court of Appeals in Washington, D.C. Friday upheld the Environmental
Protection Agency’s State Implementation Plan (SIP Call) or transport rule
designed to reduce NOx emissions in the country’s most eastern states.
Although other major EPA air-pollution control programs remain tied up in federal
court, the SIP Call program, which requires power plants and other industries to
comply with stringent NOx limits beginning with the 2003 ozone season, seems
for now to have a green light.
